Stand up for your rights. If the law says that one year of separation is required, then that's what the law says - not sure you can just skip months in a calendar year at one's own convenience. And she has to respect the economic impact that a one-year separation will have on you. She shouldn't get furious. She should be cooperative (within reason). Maybe she can help pay for a more expensive place for you if it means that much to her.

Be careful about recording phone conversations. Depending on the state, it could be considered criminal wiretapping. I'd consult with an attorney before recording anything where someone has a reasonable expectation of privacy.

If you can't afford to keep your family home, then I don't think that you should worry about leaving your family home. What's more important is your overall financial health. Not worried about criminal prosecution - that's not the problem with "adultery." Rather, as your attorney said, it could make you look less perfect, less suitable as a parent. I think you'll still see your kids, but perhaps he could get a more favorable settlement financially. I say *could*, but that's not absolute of course. It might not change much at all.

You're simply being compassionate, which is good. You can still love the person and not love how you feel living with that person 24/7 - there's a difference. Divorce is sad because it's the end of a relationship. But when you think about it, all relationships end eventually. Appreciate the memories of the past together - cherish the good ones.
